Withdrawal & Refund Policy
Updated: 17 October 2026

1. Scope and digital delivery

This policy applies to purchases of Metadatica FULL, downloadable software supplied electronically by Roberto Ruggeri, trading as Phono Analytica. Metadatica is not a physical product: no shipping, physical returns, return packaging or return postage is involved.

Metadatica FULL is offered as a one-time purchase with a perpetual Standard Individual Licence, intended for use by one named licensee on up to two computers belonging to that licensee. The same individual licence covers personal use and independent professional practice. Purchases made on behalf of companies, institutions, public authorities and other organisations require separately agreed licensing arrangements. The product offer and the applicable licence describe the specific version, technical requirements and activation conditions.

2. No additional voluntary change-of-mind refund policy

Phono Analytica does not offer a separate voluntary trial, a satisfaction guarantee or an additional commercial refund period for a change of mind. This does not limit any mandatory consumer right of withdrawal, cancellation, refund or other remedy under applicable law.No statement on this page excludes statutory rights for non-supply, lack of conformity or other legally recognised grounds.

3. Consumers in the European Union and the United Kingdom

Where the applicable EU or UK consumer rules govern a distance purchase of downloadable digital content, the ordinary right-of-withdrawal or cancellation period is14 days from conclusion of the contract, unless an applicable statutory exception has validly taken effect. Legally required extensions or other mandatory protections remain applicable where relevant.

Immediate digital supply:the applicable rules may permit this 14-day right to be lost once supply of the digital content has begun, but only where the required conditions are met. For paid downloads these include, where applicable: (a) the consumer’s prior express consent to begin supply during the withdrawal period; (b) the consumer’s express acknowledgement that beginning supply means losing the withdrawal or cancellation right; and (c) the contract confirmation, including the consent and acknowledgement, provided on a durable medium as required by law.

Merely placing an order, paying, or accepting general terms is not by itself a substitute for the legally required consent, acknowledgement and confirmation. The loss of the change-of-mind right cannot be assumed unless the relevant steps have actually been completed. An automated order-confirmation process may deliver the required durable-medium confirmation; no individually written email from the seller is necessary if the automatic process meets the legal requirements.

4. Exercising a right of withdrawal when it still applies

If your statutory withdrawal or cancellation right remains available, you may exercise it by sending an unequivocal statement of your decision toinfo@phonoanalytica.combefore the applicable deadline. Giving a reason is not required for a valid statutory change-of-mind withdrawal. You may use the optional form below, but it is not mandatory.

Optional withdrawal notice:
To: info@phonoanalytica.com
I hereby notify you that I withdraw from my contract for Metadatica FULL.
Order number: __________
Order date: __________
Name: __________
Address: __________
Date of this notice: __________

Where a refund is due following a valid withdrawal under the relevant EU or UK rules, reimbursement will be made without undue delay and within the period required by law, normally within 14 days of receiving the withdrawal notice, using the original payment method unless another method is validly agreed without additional cost to the consumer.

5. Non-supply, defects and statutory conformity rights

Any loss of the right to withdraw for a simple change of mind isseparatefrom the rights that may arise if the software is not supplied, is defective or does not conform to the contract. Mandatory remedies under applicable law can include bringing the digital content into conformity, a price reduction or termination with reimbursement where the statutory conditions are met. These rights cannot be removed by describing the software as downloadable or by excluding voluntary refunds.

For non-delivery, activation problems or suspected defects, contactinfo@phonoanalytica.comwith your order reference and a clear description of the issue. No paid individual technical-support, remote-configuration, training or forensic-interpretation service is included in the purchase; the user manual is provided separately. This does not remove legal duties concerning conformity, required updates, complaints or remedies.

6. Customers outside the European Union and the United Kingdom

No additional voluntary change-of-mind cancellation or refund period is offered.Any mandatory right applicable to the particular purchaser and transaction is fully preserved, including a locally mandated withdrawal period, mandatory refunds and remedies for digital-content defects or non-supply. The duration, exceptions and exercise of such rights depend on the applicable law. This policy does not claim that one worldwide withdrawal period applies to every purchaser, and it does not override non-waivable local consumer protections.

7. Related documents and contract confirmation

For the licence scope and the applicable restrictions seeMetadatica Licensing Information. For detailed terms, liability and statutory protections seeMetadatica Legal & Privacy. Where legally required, the customer must be given the contractual information and confirmation on a durable medium, including confirmation of any consent and acknowledgement relating to immediate digital supply. These requirements must be implemented in the actual checkout and order-confirmation process; publishing this page alone does not establish that they have been met.

Mandatory rights take precedence if any part of this policy conflicts with the law applicable to the purchaser. Changes to this policy do not retrospectively remove rights already acquired under a valid contract.
